Terms of Service

This Terms of Service Agreement ("Agreement") is entered into by and between Planthropi ("Company," "we," "us," or "our") and the individual or entity ("Customer," "you," or "your") accessing or using our services or placing an order through our website. By accessing or using our website or placing an order, you agree to be bound by the terms and conditions set forth below. If you do not agree, you may not access or use our services.
1. Product Guarantee
1.1 Guarantee Coverage:
Planthropi guarantees that plants and trees will arrive in healthy and vibrant condition. Customers must contact us within five (5) days of delivery to report any issues and provide photographic evidence to be eligible for resolution.
1.2 Exclusions:
The guarantee does not cover:
· Plants purchased outside their recommended growing zones.
· Plants that receive inadequate care.
· Normal acclimatization effects, such as minor leaf drop or slight size variations.
1.3 Resolution Options:
If issues arise within thirty (30) days of delivery and are deemed valid by Planthropi, we may:
· Issue store credit equal to the amount paid at the time of purchase.
· Approve a replacement.
1.4 Dormancy Guarantee:
Deciduous trees ordered between October 15th and June 15th that fail to emerge from dormancy by June 15th may be eligible for assistance. Customers must contact us by June 15th with clear photographic evidence to qualify.
2. Shipping Policy
2.1 Shipping Timeline:
Orders are typically processed within one (1) to three (3) business days and delivered within three (3) to four (4) business days after shipping.
2.2 Delays:
Planthropi is not responsible for shipping delays caused by carriers, weather, or local disruptions.
2.3 Weather Holds:
Orders may be temporarily delayed due to extreme weather conditions to ensure plant health. Customers will be notified of any such delays.
2.4 Non-Business Days:
We do not process or ship orders on weekends or U.S. holidays.

3. Planting Preferences
3.1 Customers may request delayed delivery to accommodate specific planting schedules. Requests must be communicated immediately upon order placement.
4. Damaged Packages
4.1 Delivery Refusal:
If a package arrives visibly damaged, customers are advised to refuse delivery. The carrier will return the package to Planthropi.
4.2 Post-Delivery Claims:
For damages discovered after accepting delivery, customers must file a claim with the carrier and contact Planthropi for guidance.
5. Returns and Exchanges
5.1 Plant Material:
Due to the delicate nature of live plants, we do not accept returns or exchanges for plant material.
5.2 Non-Living Items:
Returns for non-living items, such as garden supplies, are governed by our Return Policy.
5.3 Alternative Disposal:
Customers unable to use or care for plants are encouraged to plant, compost, or gift them to others.
6. Cancellations
6.1 Timeframe:
Orders may be canceled or modified within two (2) hours of placement without penalty.
6.2 Restocking Fees:
Cancellations after two (2) hours may incur a 25% restocking fee if the order has been processed.
6.3 In-Transit Orders:
Orders canceled while in transit are subject to an interception fee of up to $50.00.
7. Assessing Plant Health
7.1 Scratch Test:
Customers should perform a scratch test to verify plant viability. Green beneath the bark indicates the plant is alive.
7.2 Dormancy:
Leaf drop, discoloration, or slowed growth during dormancy (fall through early spring) is normal. Claims for plant loss due to dormancy will only be reviewed after sufficient time has been allowed for plants to exit dormancy.
8. Disclaimer: Environmental Risks
Planthropi is not liable for plant failure caused by:
· Weather, animals, or neglect.
· Improper planting or unsuitable growing conditions.
· Soil quality, drought, or disease.
Customers are responsible for researching local conditions and ensuring proper care.
9. Plant and Tree Variability
9.1 Size and Appearance:
Plants may arrive smaller or less developed than depicted on the website due to seasonal or growth variations.
9.2 No Refunds for Size Variations:
Refunds or replacements will not be provided for healthy plants that are slightly smaller than listed dimensions.
9.3 Imagery:
Images on the website depict mature specimens for illustrative purposes and may not represent the plants' appearance upon delivery.
10. Store Credit for Non-Shippable Items
Orders for fruit or citrus products that cannot be shipped due to regulatory restrictions will receive store credit equal to the purchase price. Store credit does not expire and can be used for future purchases.
11. Discounts and Coupons
11.1 Limitations:
Only one (1) coupon code may be applied per order. Coupons cannot be combined or applied retroactively.
11.2 Modification:
Planthropi reserves the right to modify or cancel promotions, discounts, or coupons at any time without prior notice.

13. SMS Communication
13.1 Consent:
By opting in, customers agree to receive SMS updates, including order status and promotions.
13.2 Opt-Out:

14. Limitation of Liability
14.1 Planthropi’s liability is limited to the amount paid for the customer’s order. Under no circumstances shall Planthropi be liable for incidental or consequential damages.
15. Governing Law
This Agreement shall be governed by the laws of the state in which Planthropi is incorporated, without regard to its conflict of law provisions.
16. Amendments
Planthropi reserves the right to modify these terms at any time. Changes will be posted on the website, and continued use of the site constitutes acceptance of the revised terms.
